Judicialization and Politization. The case of In Vitro Fertilization (IVF) in Costa Rica
Abstract
This research note proposes a model for the study of the relations between the Executive and Judicial Powers in Costa Rica from the perspective of the studies framed on judicial politics. This is the case of the In Vitro Fertilization technique and characterizes the different conjunctures of this process from game theory. From the analysis it can be concluded that the Constitutional Chamber, in the case of Costa Rica, is the protagonist when it comes to reversing certain types of public policies emanating from the Executive Branch, however, this role has recently begun to be reviewed by the mechanisms of judicialization from abroad triggered by a supranational human rights body.Downloads
